Mantria CIO Dead at 53. Suicide Unconfirmed.

May 15, 2013 - Mantria CIO, Yourvibe.com co-founder and CIO, and Troy Wragg's uncle died on May 12, 2013. It has been reported to this website, though unconfirmed, that suicide was the cause of death and took place in the bedroom of his rented Sarasota, Florida home. While Gruber built the many computer systems at Mantria,  he had not been charged in the Mantria Ponzi scheme.George Gruber was one of eight people related to Troy Wragg that worked at Mantria.

March 19, 2013 - Just a couple of weeks ago, I posted a followup to Mantria Receiver's Enron-like balance sheet with Revisiting the Mantria Receiver's Enron-like Balance Sheet. In the followup, I wrote the assets at most were valued at $1.2M against liabilities of $42M. 
The Receiver posted a balance sheet to PACER for the period ending December 31, 2012 and he also has Mantria's assets valued at $1.2. How did that happen? Only one year ago, he had assets listed at $4.3M. Where did $3M go? >>Read more.

March 8, 2013 - What's the hurry? With no apparent oversight of the Mantria Receiver it is actually a surprise that he does any work at all, say most, if not all, of the Mantria victims. An embarrassment to the firm of Alvarez & Marsal, the Mantria Receiver, John Paul Anderson,  continues to show little progress in the nearly THREE years he has "managed" the Receivership.  Yes, it will be THREE years next month when John Paul Anderson was appointed by Judge Arguello. I wonder if she thought this Receivership would be needed this long and for another 3-4 years.

March 5, 2013 - Remember the Mantria Receiver's Enron-like balance sheet? I had a lot of criticism regarding this glorious piece of fiction that had a sole purpose of convincing the court that there was enough money to support a Receiver for the Mantria assets. The balance sheet makes wild assumptions and lists sources of revenue that will never materialize and the Receiver has shown that if we place "Unknown Value" next to each of these new line items it makes everything okay and does not require explanation.

Wragg has gone from biochar fraud to the red carpet, to CEO of YourVibe.com, through a $50k investment from Amanda Knorr's mother.  Wragg craves the spotlight and is a "gangsta wannabe" so it is no surprise that he is getting back out into the spotlight with photos on the red carpet and with celebrities most do not know. Maybe, in his "gangsta" circles, people are impressed with his ability to put together a $54 million Ponzi scheme and with the possible criminal charges pending.

As usual, the Receiver submitted 8 pages to the court that is made up of a copy and paste of the last 9 quarterly reports with a few nuggets of new information. We can all probably agree that listing 3 bullet points on a page and submitting to the court would make it difficult for the Receiver and his team to justify their fees.

October 17, 2012 - For the Mantria victims of the "Fogotten" Ponzi scheme and the SEC, YourVibe.com, Amanda Knorr and Troy Wragg's company they have been working on for the last 2 years, is the only chance for either group to see money that could possible pay the victims back. Yes, the only chance. While there is litigation and mediation that will take place by the Receiver against the Gatekeepers, I would not expect much to come from it, except that the lawyers will  make great money from this, but little for the victims. It is my opinion that as the days go by, victims will receive less money because attention on this case will continue to decrease  until finally everyone involved in the case will just want it off their desks and they can do so because no one is paying attention.

October 8, 2012 - Final judgments have been approved, the SEC will receive (LOL!) $135 million from the Ponzi schemers Troy Wragg, Amanda Knorr, Donna McKelvy and Wayde McKelvy, and Judge Arguello has officially closed the civil case. Before the Mantria victims become excited that there will be some money left over in the Mantria and Speed of Wealth bank accounts, Judge Arguello will continue to approve expenses accrued by the Receiver and his team of accountants and lawyers.

Final Judgments Complete: $135M Wragg, Knorr, McKelvys

September 17, 2012 - With the SEC's civil suit now completed, the court last Thursday has ordered Troy Wragg, Amanda Knorr, Donna Mckelvy and Wayde Mckelvy to pay nearly $135 million in disgorgement, interest and penalties within 14 days of September 13, 2012.

September 14, 2012 - The government is making it really easy for Troy Wragg and Amanda Knorr to pay the $77 million owed to the government. They can simply pay using the website Pay.gov, ACH transfer, certified check, bank cashier’s check, or United States postal money order payable to the Securities and Exchange Commission within 14 days of submission of the final judgment.

Hohenwald Tennessee Biochar Plant Follow Up

September 7, 2012 - A few weeks ago, I posted about "The Hohenwald Biochar Plant: Then and Now", and here's an update to that story. 

As we know, Mantria left victims all over the country, including the owner of the building in Hohenwald, Tennessee, where a large biochar plant was to be built that would meet the entire town's power production needs, as well as produce soil-enhancing biochar and other "BioProducts". Wragg said that Hohenwald "is producing $6.2 million annually", yet the site was never developed for biochar production, it was just an empty building.

Why Arbitration with Tatum in Receiver v. Gatekeepers?

August 30, 2012 - So, we have the trial date set for June 3, 2013 in the Receiver's lawsuit against the Mantria gatekeepers, but an often asked question is why is the Receiver going to arbitration with Tatum (also know by the parent companies Randstadt or SFN) and trial with the other gatekeepers? Of all the gatekeepers, Tatum is definitely viewed as the "big fish" and offers the greatest potential for the victims to recover their losses, while the other gatekeepers would represent a small fraction of the victims' losses, in my opinion.

The Hohenwald Biochar Plant:  Then and Now

August 16, 2012 - Mantria had raised $9.2 million from investors to build a biochar plant in the town of Hohenwald, Tennessee (228 Industrial Avenue), but it was never built. Wragg and Knorr promised enough electricity would be created at this plant to power the entire town, visitors from around the world would visit Hohenwald to see this amazing technology, and they even said it would create a permanent structure for a tourist center and EternaGreen University where people would learn about the magic of biochar.

There has been no end to the SEC civil suit that began with this press release, no criminal charges and a depletion of the little cash that was available gone to lawyers and accountants ($320 - 450/hour!).

August 10, 2012 - "Don't blame us, we're just headhunters" is the defense Tatum/SFN has decided to go with in the lawsuits by the Receiver and investors, even though they had three of its partners  (Dan Rink, Stephen Markert, Elizabeth Shuttleworth) working with Mantria. A few months ago, an article was found that was written by Tatum and published in the August 2007 Philadelphia Business Journal titled Here's Why the CFO Position is Currently a Revolving Door outlines some of the work Tatum did at Mantria and Tatum takes credit for more than "headhunting" while working with Mantria. The article was written by Andrew Reckner, the managing partner of Tatum's Philadelphia practice.

July 28, 2012 - This past week offered absolutely nothing to write about.  We have been waiting for Judge Arguello's ruling in the Motion for Final Judgment, as it has been more than a month since the SEC responded to Wragg/Knorr attorney's legal nonsense and silliness, and more than 5 weeks since the Denver hearing where Amanda Knorr testified.

We are also waiting for the latest quarterly report of the Mantria Receiver to learn how much more money has been drained from the Receivership while the Mantria victims (employees, creditors and investors) maintain their record of 984 days of receiving zero dollars (bagel, donut, nada). July 15, 2012 - One would think that the news of setting a trial date in the Receiver's case against the gatekeepers would warrant an email to all of the Mantria victims by the Receiver. If you thought that, you have forgotten that the victims have a communication-challenged Receiver. No one has heard from John Paul Anderson in 3 months and his website had been dormant...remember the promise of monthly updates? (see #14 at the Receiver's FAQs). Amanda Knorr testified at the hearing and claimed that she has no money and even indicated the location of her and Wragg's bank accounts.Where will Wayde Mckelvy get more than $6.2 million that is expected in disgorgement? Pink diamond and Mexico real estate? How many bath tubs does Donna McKelvy need to sell to pay her more than $440k? June 30, 2012 - Last week, I wrote a post titled "Wragg / Knorr Attorney: Why do my clients have to pay so much?" where I wrote that Steven Feder, attorney for Troy Wragg and Amanda Knorr, was wasting the court's time and delaying the inevitable. Not only is this true, but the SEC just responded to the supplement submitted to the court and it appears that Steven Feder supports the SEC's position on calculation of disgorgement! (Or, is Wragg still afraid of a 70-year old, "blind afghanis" and "ballers" and did not want to come to Denver?)  Is it possible to plead the fifth when it does not work in you favor and withdraw the privilege when you want to tell the court about your hardship and nonsensical, irrelevant details of you life? June 26, 2012 - Oh, our legal system. Have you ever just wanted to shake your head at some of the nonsense some lawyers put out there? You may want to do some stretches for your neck because there is a lot of head-shaking that will occur. I am not a lawyer, but when something does not make sense I believe it is fair to point it out, though I will let you come to your own conclusion. Clearly, Feder is wasting the court's time and is simply trying to delay the inevitable.

US Attorney John Walsh (pictured) announced that David Taylor will received 70 months in prison for a scheme that solicited $2.2 million from Colorado investors. So, 6 years in prison for a $2 million scheme, what does a $54 million scheme get?

May 28, 2012 - After SEC attorney Tom Krysa  called the Wragg's and Knorr's motion "a last-ditch effort to delay enforceable money judgments against them, Wragg and Knorr have filed a meritless motion to stay", Federal Judge Arguello denied this motion on May 25, 2012.

Troy Wragg and Amanda Knorr, of course,  want the motion for final judgment to be denied, and their lawyer requested that the the Judge should deny or stay this motion because 1) we should wait for the outcome of the Receiver and investors' lawsuits (i.e. many, many years), and the outcome of the grand jury investigation,   2) we dispute the amounts ($37M) and   3) we never admitted to the allegations.

Receiver's Seventh Application for Approval of Payments

May 25, 2012 - In the Receiver's 2 years on the job we have seen the cash account dwindle from $719,000 to $457,000, and this includes cash inflows from the sale of refinery equipment, cars, horses and logging operations, so we'll see a zero cash account in the not-so-distant future and probably before a nickel goes to any of the Mantria Ponzi victims.  Based on the latest report, we are seeing an attempt to reduce cash outflows.

May 21, 2012 - The search by a Philadelphia law firm has begun for victims of a $54 million Ponzi scheme dubbed last year as the largest green scam in America -- in part evolving from a City Avenue company called Mantria.

Attorney Patrick Howard, of Saltz, Mongeluzzi, Barrett &  Bendesky, said yesterday that the first briefs in the class action suit are due Friday. Those will likely be motions by defendants to dismiss the lawsuit.

Wragg/Knorr Respond to Motion for Final Judgment

April 14, 2012 - It is no surprise that Mantria Ponzi scheme leaders and rap music video extras Troy Wragg and Amanda Knorr want the motion for final judgment to be denied, but their lawyer seems to be reaching with these reasons. In summary and without legal jargon, Troy Wragg and Amanda Knorr believe the Judge should deny or stay this motion because 1) we should wait for the outcome of the Receiver and investors' lawsuits (i.e. many, many years), and the outcome of the grand jury investigation,     2) we dispute the amounts ($37M) and    3) we never admitted to the allegations.

April 8, 2012 - In its 28 page motion to dismiss, Tatum/SFN group is going with, "Don't blame us, we're just headhunters", in other words, we were paid great money for placing Rink and we cannot make any guarantee on the ethics or integrity for those we place.

It sounds like a good approach, except we know that Daniel Rink was a partner in Tatum LLC, as well as the fact there were other Tatum partners who worked at Mantria, Stephen Markert and Elizabeth Shuttleworth (Any others? Please let me know).

It was only 6 weeks ago when John Paul Anderson, of Alvarez and Marsal, the Receiver, created some excitement with the investors when he actually took the time (probably about 10 minutes) to send an email updating them on the progress, or lack of progress depending on how you look at it.

March 19, 2012 - The victims are pinning their hopes on the Mantria Receiver and his litigation against the "gatekeepers", but I am not as hopeful that this Receiver is the right person to get this job done, as demonstrated by his work these last 2 years (read this, this, this, this and this) . In my opinion, we should expect very little from the litigation, but what if the Ponzi defendants can pay the restitution outlined in the motion for final judgment? I don't expect much from Wayde McKelvy and Donna McKelvy, but how about the nearly $40 million from Troy Wragg and Amanda Knorr? Is YourVibe.com the answer?

Receivership Balance Sheet: Enron Would Be Proud

March 14, 2012 - This is not a good-looking balance sheet. Actually, it is not really a balance sheet, it is more of a wishing well. You see, a  balance sheet is a statement of the assets, liabilities, and capital of a business or other organization at a particular point in time. Not a future point in time, but at the date listed on the balance sheet. In this case, the Receiver put together a balance sheet for the date December 31, 2011  and should be listing the assets, liabilities and capital on that date. Instead, a document was put together that would make Enron and WorldCom accountants proud, but, at least, these companies would bury the nonsense in a footnote. Here, we don't even get a footnote.

February 25, 2012 - The SEC has filed a motion for final judgment against Troy Wragg, Amanda Knorr, Wayde McKelvy and Donna McKelvy. According to this document, "Defendants Troy B. Wragg and Amanda E. Knorr oppose this motion.  Defendant Donna M. McKelvy does not oppose this motion, though she wishes for the smallest monetary judgment possible against her.  Wayde M. Small Victory for Mantria Ponzi Victims

February 25, 2012 - Though not a monetary victory, the victims of the Mantria Ponzi scheme now have a Receiver that is making an attempt to communicate. The Receiver's web site now has updated court documents and FAQs and he wrote on his site that the victims can expect monthly updates. This blog has been critical of the Receiver's lack of communication (none for 17 months), poorly managed web site (last updated Oct. 2010), high fees and slow progress in his nearly 2 years as Receiver (read this, this, this and this), maybe John Paul Anderson and the principals at Alvarez and Marsal are readers, and will continue to report the progress in this case.  > >   Read more.
