While the Receiver's litigation against the gatekeepers goes nowhere, or actually backwards as it has been delayed by more than a year
, the Investors' Class Action lawsuit continues its case against the gatekeepers. There are multiple updates and the documents follow at the end of this post.
- Conference on Thursday, March 28, 2013: A scheduling conference with the magistrate judge will take place. The joint scheduling order is below with an overview of the case and positions on settlement. The goal is to get some agreement on dates, timing, etc.
- The biggest issue that needs to be addressed is that Tatum wants to “bifurcate” discovery, which means they want to put off reaching the merits of the case, until after the Court decides class certification. This is a common tactical move that defendants try in these types of cases. Tatum's motion and the opposition's view is below. This blog does get a mention, though erroneously attributes this blog to the work of the investors.
